Joulary Terms of Use
These terms apply when you use the Joulary app and its servers ("Joulary"). In these terms, "we", "us" and "our" mean Alexey Yudichev, a sole trader trading as Joulary. Our address is Unit 172196, PO Box 7169, Poole, Dorset, BH15 9EL, United Kingdom. You can contact us at support@joulary.com. By creating an account you agree to these terms. If you do not agree, do not use Joulary.
What Joulary does
Joulary plans when your electric car charges at home, using your electricity tariff, published and forecast prices, and the trips in your calendar. It then sends charging and climate commands to your car through the car maker's own systems. The privacy notice explains what data this involves.
Joulary is free. It has no adverts and no in-app purchases.
What you need
To use Joulary you need a Tesla (not a Model S or Model X built before 2018) on a Tesla account that holds only that car, an Octopus Energy account on the Agile tariff, a home in the United Kingdom where you can plug the car in to charge, an iPhone or Android phone that can install Joulary from the App Store or Google Play, and an internet connection. You need to give Joulary access to your Tesla and Octopus accounts. A Google or iCloud calendar is optional. The Manual has the details.
Who can use it
You must be at least 18 and live in the United Kingdom. You may connect only a car, an electricity account and calendars that you own or are allowed to manage.
Your account
Keep your sign-in details to yourself. You are responsible for what you, or anyone you let use your account, do with it. If you think someone else has used it, tell us straight away at support@joulary.com. We are responsible for misuse of your account that our own failings cause.
You can delete your account at any time in the app (Profile, then Delete account). Deleting it disconnects your car, electricity account and calendars, and erases your data as the privacy notice describes.
If you do not use Joulary for about two years, we will close your account. We will email you and notify your phone about two months before, and signing in before then keeps it open.
This agreement lasts until you delete your account or we close it as these terms describe.
Your licence to use the app
While you have an account, you may use the Joulary app for your own personal use. You may not copy, sell or reverse engineer it, except where the law allows.
Other companies' services
Joulary is not made, endorsed or supported by Tesla, Octopus Energy, Google, Apple or any other company whose service you connect. Your use of those services stays under their own terms. If one of them changes, limits or withdraws what Joulary relies on, parts of Joulary may stop working.
Price forecasts come from AgilePredict, with x2r and agileforecast.co.uk as back-ups. They are estimates, and the real prices Octopus publish can differ from them.
If you installed Joulary from the App Store, Apple's standard licence terms for apps also apply. These terms set out what you and we agree between us.
Checking your car yourself
Joulary helps you charge at cheaper times. It cannot guarantee that you will save money, or that your car will reach a given charge by a given time. Charging can be delayed or missed when the car is asleep or offline, when a service Joulary depends on fails, when prices or forecasts are wrong, or when a calendar entry is missing or changes late.
Before a journey that matters, check your car's charge yourself. Do not rely on Joulary when running out of charge would put you or anyone else at risk. You can turn smart charging off at any time in the app. You can also remove Joulary's access to your car in your car maker's account settings, which stops Joulary controlling the car altogether.
The help assistant in the app answers questions using an AI model. Its answers can be wrong. Check anything important before you act on it.
Fair use
Do not misuse Joulary. In particular, do not try to get into other people's accounts or data, interfere with the servers, get around limits such as how often the app can make requests, or use automated tools to call Joulary in ways the app does not. If you break these terms seriously or repeatedly, or if we need to protect other users, our servers or a car, we may suspend or close your account. Where we can, we will warn you first and give you a chance to put things right. We will tell you why unless the law or someone's safety prevents it.
Changes to Joulary and to these terms
Joulary will change over time. We may add, change or remove features to keep up with changes at Tesla, Octopus or the other services it uses, to fix problems, to improve security or to meet the law. If a change removes something you rely on, we will tell you in the app before it happens where we can.
Joulary may stop altogether. If it is going to close, we will email you at least 30 days before, so you can export your data. If a company Joulary depends on withdraws access with less warning than that, we will tell you as soon as we can.
We may change these terms when Joulary changes, when the law changes, or when a service Joulary connects to changes its own terms. If a change matters to you, we will tell you in the app or by email at least 30 days before it takes effect, unless a change in the law or a security problem needs it sooner. If you do not want to accept it, you can delete your account before then. The effective date at the top of this page shows when these terms last changed.
We may transfer this agreement to another person or company, for example if Joulary is later run by a company. We will tell you before it happens, and your rights under these terms will stay the same. If you do not want to continue, you can delete your account.
Liability
Joulary is free, and we take reasonable care and skill in providing it. It depends on your car, your internet connection and other companies' services, so we cannot promise it will always work.
If we break these terms or fail to take reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss is foreseeable if it was obvious it would happen, or if you and we both knew it might happen when you started using Joulary.
We are not responsible for:
- loss or damage that was not foreseeable;
- loss or damage we did not cause, for example when your car, Tesla, Octopus or a forecast site fails, or when prices or forecasts turn out different from what was expected, unless we were also at fault;
- the part of any loss you could reasonably have avoided, for example by checking your car's charge before a journey that matters, as described in "Checking your car yourself";
- business losses, such as lost profit or business interruption. Joulary is for personal use.
Some liability cannot be limited by law. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Nothing in these terms takes away your legal rights as a consumer. For free advice about them, contact Citizens Advice (citizensadvice.org.uk), Advice Direct Scotland (consumeradvice.scot) or, in Northern Ireland, Consumerline (nidirect.gov.uk/consumerline).
Complaints
If you are unhappy with Joulary, email support@joulary.com or write to us at the address at the top of this page. We will reply within 10 working days and try to put things right. If we cannot agree, you can take the matter to court, for example through the small claims process. We do not use an alternative dispute resolution scheme.
Law and disputes
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you also keep the protection of the consumer laws that apply where you live, and you can bring a claim either in your local courts or in the courts of England and Wales.
If something goes wrong, please contact us first (see "Complaints"), and we will try to put it right. If a court decides that part of these terms cannot be enforced, the rest still applies.
